Determining highly qualified status is a federal, not a state requirement. The federal requirements deal only with content expertise, not pedagogy or other indicators of qualification dealt with in state licensure requirements. School districts determine whether teachers are highly qualified under rules created by the state, but requirements created by the federal government. School districts are required to certify the qualifications of teachers as a condition of receiving federal money. The State Public Education Department only collects data on the highly qualified status of a district's teachers but is not responsible for determining that status.
